These Terms of Use ("Terms") are a legal agreement between you and the developer of Image to Prompt AI ("the App", "we", "us"). By downloading, installing or using the App you agree to these Terms. If you do not agree, do not use the App.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, decompile, redistribute, resell or sublicense the App or any part of it.
The App analyses an image you provide and returns a descriptive text prompt intended for use with third-party AI image generators such as Midjourney, DALL·E and Stable Diffusion. Generated prompts are produced automatically and may be inaccurate, incomplete or unsuitable for your purpose. You are responsible for reviewing any output before relying on it.
You agree not to use the App to submit or generate content that is unlawful, infringing, defamatory, hateful, harassing, sexually explicit involving minors, or that violates the rights of any person. You must have the necessary rights to any image you submit. You may not use the App to impersonate any person or to produce content intended to deceive.
You retain ownership of the images you submit. You are responsible for ensuring you have the right to use them. Subject to your compliance with these Terms, you may use the text prompts generated by the App for any lawful purpose, including commercially. Because prompts are generated automatically, we make no claim of ownership over them and cannot guarantee they are unique to you.
The App relies on third-party services to function, including an AI processing provider that analyses submitted images, Apple's App Store for payment, RevenueCat for subscription management, and Firebase for configuration, notifications and crash reporting. Your use of the App is also subject to those providers' terms. See our Privacy Policy for details on what data is processed.
We may modify, suspend or discontinue the App or any feature at any time. We may update these Terms from time to time; changes will be posted on this page with a revised date. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
The App is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the App will be uninterrupted, error-free or that any output will meet your requirements.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of or relating to your use of the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.
This licence is effective until terminated. It terminates automatically if you fail to comply with these Terms. You may terminate it at any time by deleting the App and cancelling any active subscription.
You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple has the right to enforce these Terms against you. Apple has no obligation to furnish any maintenance or support services for the App, and is not responsible for addressing any claims relating to the App.
These Terms are governed by the laws of the jurisdiction in which the developer is established, without regard to conflict of law principles, except where mandatory local consumer protection law applies to you.
